These Terms and Conditions govern your access to and use of the services provided by LunaBirth Doula, operated by Myriam Liaigre (referred to as "we", "us", or "our"). By engaging our services, visiting our website, or booking a consultation, you agree to be bound by these terms. Please read them carefully.
1. Our Services
LunaBirth Doula offers professional doula support services, including but not limited to birth preparation, labour and birth support, postpartum accompaniment, breastfeeding guidance, and educational resources. Services are provided by Myriam Liaigre, a certified doula.
Our role is to provide emotional, physical, and informational support. We do not provide medical advice, diagnoses, or clinical care. All medical decisions remain the responsibility of the client and their healthcare team.
2. Bookings and Agreements
A service agreement is only confirmed once:
• You have completed and signed a service contract;
• A deposit or full payment has been received, as specified in your package.
We reserve the right to decline a booking at our discretion prior to signing of any contract.
3. Fees and Payment
All fees are outlined in your personalised service proposal or on our website at the time of booking. Prices are subject to change, but confirmed bookings will honour the agreed price.
Payment may be accepted by bank transfer or other methods communicated to you at the time of booking.
4. Cancellations and Refunds
4.1 Cancellation by Client
You may cancel your booking by notifying us in writing. The following conditions apply:
• Cancellations made more than 4 weeks before the due date or start of services: 50% of the total amount will be retained. This is because our service begins from the moment the contract is signed (prenatal support, availability, preparation work), and this covers the time and resources already committed.
• Cancellations made within 4 weeks of the due date or service start: full payment is non-refundable.
• If birth occurs unexpectedly early and we are unable to attend, a compensation may be considered, at our discretion.
4.2 Cancellation by Us
In the unlikely event that Myriam Liaigre is unable to provide services due to illness, emergency, or other circumstances beyond our control, we will arrange a qualified substitute doula.
5. Scope of Support
Doula services are not a substitute for professional medical or mental health care. We strongly encourage all clients to maintain regular contact with their midwife, obstetrician, or GP throughout pregnancy and postpartum.
We do not perform clinical examinations, administer medication, or make medical decisions on your behalf.
6. Confidentiality
LunaBirth Doula treats all personal and sensitive information shared by clients with strict confidentiality. We will not disclose your information to any third party without your explicit consent, except where required by law.
7. Sale of Products
In addition to our doula services, LunaBirth Doula offers a selection of carefully chosen products to support your pregnancy, birth, and postpartum journey. These include, but are not limited to, rebozos, birth kits, and lactation shells.
Orders and Payment
Products may be purchased as a standalone item or as part of a service package (such as The Deluxe Birth package). Full payment is required at the time of order. Prices are displayed at the time of purchase and are subject to change without notice, though confirmed orders will honour the price agreed at checkout.
Delivery
Products may be delivered by post or collected in person, as agreed at the time of purchase. Delivery timescales will be communicated upon ordering. We are not responsible for delays caused by postal services or customs. Any applicable shipping costs will be clearly stated before payment is taken.
Returns and Refunds for Products
Due to the personal and hygiene-sensitive nature of our products, the following return policy applies:
● Rebozos: returnable within 14 days of receipt, provided they are unused, unwashed, and in their original condition.
● Birth kits: non-refundable once dispatched, as these are curated and sealed for hygiene purposes.
● Lactation shells: non-refundable due to their intimate and hygiene-sensitive nature.
If a product arrives damaged or defective, please contact us within 48 hours of receipt at lunabirthdoulamallorca@gmail.com with a description and photographs. We will arrange a replacement or refund as appropriate.
8. Intellectual Property
All content on the LunaBirth Doula website, including text, images, resources, and course materials, is the intellectual property of Myriam Liaigre unless otherwise stated. You may not copy, distribute, or use this content for commercial purposes without our prior written consent.
9. Limitation of Liability
LunaBirth Doula and Myriam Liaigre will not be held liable for any indirect, consequential, or special damages arising from the use of our services. Our total liability shall not exceed the amount paid for the specific service concerned.
We are not responsible for outcomes related to medical decisions, birth complications, or actions taken by your healthcare providers.
10. Behaviour and Respect
We are committed to providing a safe, respectful, and inclusive environment. We expect the same in return. We reserve the right to terminate services without refund in cases of abusive, threatening, or discriminatory behaviour toward us.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. Significant changes will be communicated via our website or email. Your continued use of our services constitutes acceptance of the updated terms.
12. Governing Law
These Terms and Conditions are governed by the laws of Spain. Any dispute arising shall first be addressed through good-faith discussion, and if unresolved, through the appropriate legal jurisdiction.
